It is a condition for any claim and payment to be made under this guarantee that the advance payment referred to above must have been received by the Applicant on his account number _____________ at ____________.

For the purpose of identification the request for payment and your confirmation have to be presented through your bank confirming that the signatures are legally binding upon your firm. If in this respect, such bank will make use of SWIFT, it will have to transmit in any case the full wording of your request for payment and of your above- mentioned written confirmation and confirm to us at the same time that the originals

of these documents, legally binding upon your firm, have been forwarded to us.

为了鉴别你方索赔请求，你方的确认书须提供你方银行证实的具有法律约束力的签名。在此情况下，你方银行使用SWIFT向我方传送文件，保证任何情况下同时传送你方书面索赔通知，你方书面确认书，和你方银行证实信息的原始文件等你方具有法律约束力的文件。

Our guarantee is valid from _____ until _____ and expires in full and automatically, irrespective of whether the present document is returned to us or not, should your written request for payment and your above written confirmation or the above described SWIFT sent by the bank not be in our possession by the data at our counters.

该保函有效期：从××到××，当保函有效期满，无论你方是否将保函正本返回我方，你方书面支付请求，你方书面确认书，或你方银行SWIFT等不再是我方控制数据。

With each payment under this guarantee our obligation will be reduced pro rata.

我方保函金额将随申请人或我方已向你方支付的金额自动作相应递减。

This guarantee is subject to the Uniform Rules for Demand Guarantees (URDG) Revision 2010, ICC Publication No.758

第二篇：预付款保函 英语版 Advance Payment Guarantee

Advance Payment Guarantee

We have been informed that (hereinafter called “the Principal”), has entered into a contract( ) , for the project of ( ) .

Furthermore we understand that, according to the conditions of the contract, a down payment in the sum of USD( ) (say United States Dollars XX) is to be made against a down payment guarantee.

At the request of the Principal, we, the undersigned, The Bank ( ), Head Office, having our registered address at ( ), hereby irrevocably undertake to pay you any sum or sums not exceeding in total an amount of USD ( ) (say United States Dollars XX)(hereinafter called "the guaranteed amount" upon receipt by us of your first demand in writing and your written statement stating:

1. that the Principal is in breach of his obligation(s) under the contract; and

2. the respect in which the Principal is in breach.

Your demand and accompanying documents shall be forwarded directly by you to us with authorized signature.

This guarantee shall become effective upon the receipt of the down payment by the Principal. The effective amount shall always correspond to the amount actually received by the Principal. But in any case not exceeding the guaranteed amount. It is a condition for any claim and payment under this guarantee to be made that the down payment has been actually received.

The maximum amount of this guarantee will be automatically reduced by percent of the total value of each part-shipment/ interim work finished against presentation to us by the principal of copies of the relevant invoice(s) and transport document(s) /the interim work certificate.

This guarantee shall expire upon the time when the total guaranteed amount has been reduced to zero in the above-mentioned manner, or until 20th, August 2014, whichever is earlier, after which this guarantee shall be automatically cease to be valid whether the original of this guarantee is returned to us or not.

Consequently any demand for payment under it must be received by us at this office on or before that date.

Any dispute over the interpretation of the conditions of this letter of guarantee shall be subject to the Uniform Rules for Demand Guarantees ICC Publication No. 458.
