第一条: 甲方委托乙方提供:□购买 □承租居住/非居住房屋的居间服务,并签订本合同以共同遵循。
1. Party B is appointed by Party A to provide brokerage services for the □purchase □lease of
residential /non-residential property by Party A. Hereby this contract shall be signed by the Parities for mutual observation.
第二条: 甲方的义务
甲方或其亲友或其任职的单位于本合同签署之日起六个月内,不得规避乙方私下与出售方/出
租方达成本合同第五条所确认房屋的买卖/租赁交易。否则,甲方应按转让价的1%、或月租金
的35%(居住用房)、50%(非居住用房)向乙方支付违约金。
2. Obligations of Party A
Party A or any of its relatives or entity affiliated by it may not, within 6 months upon the signature of this contract, make any 'backroom deals' with seller/lessor introduced by Party B for the sale/lease of real estate listed in Article 5 hereof. Otherwise damages calculated as 1% of transfer price or 35% of monthly rent (residential property) or 50% of monthly rent (non-residential property) of real estate hereunder shall be paid to Party B by Party A.
第三条: 乙方的义务
1、通过乙方的销售渠道,早日完成甲方委托之交易,并协助甲方与出售方/出租方斡旋。
2、不得与他人恶意串通,损害甲方的利益。
3. Obligations of Party B
1) Party B shall fulfill the transaction entrusted by Party A hereunder as quickly as possible
through its resources and provide assistances to Party A for the negotiation with seller/lessor.
2) Party B may not prejudice the interests of Party A by collusion with any third party.
第四条: 服务报酬
乙方完成甲方的委托事项时,即甲方与乙方所介绍的出售方签订房地产买卖合同(及类似文本)
或与乙方所介绍的出租方签订租赁合同时,甲方按下列标准一次性向乙方支付服务报酬:
1、甲方买受房屋的,为实际成交总价款的 %。
2、甲方承租房屋的,为实际成交月租金的 %(居住用房)、 %(非居住用房)。
4. Service Charge
Party A shall, at the fulfillment of transaction entrusted by Party A hereunder, i.e., sales contract or similar instrument has been entered into by Party A and seller introduced by Party B or tenancy contract has been entered into by Party A and lessor introduced by Party B, pay Party B service charge as follows:

第六条: 甲乙双方在履行本合同中所产生争议的,应协商解决,协商不成的,双方同意由上述引发争议

1.
租房,甲方确认:乙方提供了相应房源供甲方参考和挑选,并由乙方工作人员按照下列看房登记表中所列时间带领甲方进入表中所列房屋进行了实地看房。
2.双方同意,乙方在帮助甲方找到满意的房屋并在签订《房屋买卖(或租赁)合同》之日收取房屋买卖成交价的2%(或1个月的租金)作为佣金,之前乙方所提供的服务均免费。
3.甲方承诺在看房后六个月内,甲方本人及其亲属、同事、代理人、授权人等与甲方有关联的人,未通过乙方而与下表中房屋的产权人或其代理人达成买卖(或租赁)交易,或利用了乙方提供的信息、机会等条件但未通过乙方而与第三方达成买卖(或租赁)交易,都视为侵害了乙方权益,甲方应在房屋交易发生之日向乙方支付买卖成交价的3%(或一个月的租金)作为赔偿金。
4.甲方如未能按时支付乙方佣金或赔偿金,则每逾期1天,则每逾期1天,须按应付款的5‰向乙方支付违约金。
5.本确认书一式两份,甲乙双方各执一份,经双方签字盖章后生效。
