甲方:

乙方:

甲方聘用乙方为员工,双方经过平等协商,彼此同意约定下述条款以共同遵守。

一、乙方之考勤与管理悉按甲方有关员工手册办理。

二、乙方受聘于甲方期间,应根据甲方工作安排,在工作场所履行职责:

三、乙方之工作职责、事项均由甲方依乙方之职务或工种,并视乙方能力及甲

方需要进行分派。

五、乙方之正常工作时间每日为***小时,工作半年以上**个小时,每月**天假,

工作满一年**天假。每月其工作、休息、休假等,均由甲方安排办理。

六、甲方根据工作需要,要求乙方加班时,除不可抗拒之事外,乙方应予配合,

有关加班事宜,均由甲方传达乙方,乙方加班费另计。

七、甲方应按月支付乙方报酬,乙方的工资待遇每月****元人民币(底薪)+10%

提成(前3个月保底***元,3个月后底薪加提成)。

八、乙方工作每满一年底薪加****元。

十、乙方每月工资由甲方次月月底发放,若工资发放日适逢周日或假日。甲方

得提前或推后一日或数日发放。

九、甲方对乙方奖励,分为表扬、嘉奖、晋级、3种。甲方对乙方之惩处,分为

警告、降级、辞退、罚款等4种。以上奖励及惩处事由和办法,依员工手册 办理之。奖励及惩处记录列为甲方考核乙方之依据之一。

十、甲方因业务萎缩或乙方不能胜任甲方工作时,甲方有权终止本合同。

十一、乙方主动提出解除本合同时,须提前3个月通知甲方,调离时,乙方须

按员工手册办理有关手续。

十二、乙方声明:乙方在签署本合同时,同时获得员工手册,并知悉全文,愿

意遵守各项规定。

十三、甲、乙双方就履行本合同所发生一切争执,同意以市劳动局为第一仲裁

机关。

十四、本合同为两年以上。甲、乙双方若不特别声明,本合同保持持续有效。 十五、员工手册

1、员工不得无故迟到、旷工、早退,特殊情况应提前向甲方请假批准。

2、员工必须保持工作场地整洁、干净。

3、员工不得营私舞弊、弄虚作假,一经发现,从重罚款处理。

4、员工不得无故辞工,特殊情况应向甲方汇报,批准。

5、甲方每月给乙方进行工作考核评估。

十六、合同期满后,乙方两年内不得从事本职业。

十七、本合同一式两份,甲、乙双方各执一份,经双方签章后于 年月日起

生效。

IT IS HEREBY AGREED THAT this employment contract, which includes the terms and

conditions stated in Annex A and any documents referred to in them and any alterations,

modifications, amendments or revisions to the same notified by the Employer to the

Employee form the contract of employment between the Employer and the Employee:

同时,本雇佣合同也包括附件A及其提及的文件内容以及在执行过程中根据情况对这些内

容进行的补充、修改和完善,并相应通知雇员。

1. General Principle (总则)

1.1 The Employment Contract is to be signed by the Employee under his notion and

common understanding. And it has been studied by himself and considered

carefully under his own sanity and his family’s permission.

本雇佣合同书是雇员在充分理解的基础上签订的。雇员在签署时,神智清

醒,无任何压力或引诱,并已取得家属支持后,经多次阅读和反复思考,完

全自愿签署的。

1.2 After this Contract is signed, the employment relationship will be established. And

it should be the behavior standard of the employee’s. Any breach for it, the

Employee will accept the relative penalty for his own deeds.

本合同签署后,雇员的一切言行必须以本合同为准则,若有违反,雇员自愿

受罚。

2.1 Task (工作安排) The Employer may at their absolute discretion assign the Employee in a different

trade/task from time to time. The Employer reserves their right to adjust the

Employee’s pay accordingly if the Employee is unable and/or is incompetent to carry out the assigned trade/task.

雇主有权根据需要将雇员安排在另一个职位工作。同时,雇主保留因雇员不

能胜任工作而对其工资进行调整的权利。

2.2 The Employee should be physically healthy and pass all the medical check by

authorized doctors in Singapore. And the employee should be a qualified

construction worker that can work at heights, bear heat, and any other tough

working environment on site.

雇员必须身体健康,能通过新加坡医院和诊所组织的体检。雇员必须是合格的建筑工人,工作时做到能吃苦,不怕晒,不怕热、适应在高空、基坑或海上工作,能够从事各项建筑施工。 Duties of Employee (雇员职责)

3.1 Job Title (工作职位)

Construction Worker 建筑工人

3.2 Location (工作地点)

Any of the work sites designated by the Employer within the Republic of

Singapore.

3.3 新加坡共和国内任何一个雇主指定的工地。 Working Time (工作时间)

The working time should be decided by the employee according the law of

Singapore. 雇员的工作时间按照新加坡的雇佣法由雇主决定。

3.4 The employee should follow the regulations and instruction by the Employer. Any

absence for work without a valid reason, the Employer could give the fine of

S$50.00. If the absence accumulated to 3 days, the Employer could perform the

right and repatriate the Employee.

雇员必须服从雇主的领导与管理。对于旷工的雇员,雇主可处以每天50.00新币的

旷工罚款。连续旷工3天者,雇主可以取消其准证并遣送回国。

4. Contract period (合同期)

The contract period is for two (2) years (the actual days should base on the

Employee’s Work Permit and Temporary Work Permit entitled by Ministry of

Manpower, but should not less than 730 days). All the employees shall strictly

follow this 2 years’ contract period. Otherwise, the Employee shall compensate to

the Employer according to the relative clause of this Employment Contract.

本合同雇佣期为两年(实际天数以新加坡人力部授予雇员的工作准证和临时工作准

证为准,但总天数不得少于730天)),雇员务必严格遵守。否则,根据本雇佣合

同相应条款,给予雇主补偿。

Upon completion of the first year’s employment, the Employer may at their

absolute discretion decide not to renew the work permit for the secondary year

without giving any reason and without being liable for any compensation to the

Employee.

在第一年雇佣期满后, 雇主根据工作需要及雇员的工作表现,为雇佣办理工作准证

延期。雇主有权辞退不合格的雇员,而不需给予原因和补偿。

If the Employee refuses to comply with this two (2) years’ contract period, the

Employee shall be responsible for his own repatriation costs to his domestic

country and all the compensation to the Employer which may be paid from the

Employee’s salary. 4.1 4.2 4.3

如果雇员在雇佣期内拒绝履行为期两年的雇佣合同,雇员必须自己承担相关遣返费

用和对雇主的赔偿。该费用由雇员从其工资中直接支付给雇主。

4.4 Upon completion of this two year’s employment, it could be extend under the

consensus between the Employer and the Employee.

两年雇佣期满,如果雇主与雇员双方同意,可以延长合同期限。

5. Work Permit (工作准证)

The Employee shall hand over his original travel/passport documents and Work

Permit to the Employer during the employment in the Republic of Singapore for

processing.

雇员在到达新加坡的雇佣之日起,应将其护照及工作准证等有关原始证件交

给雇主保管。

6. Salary (工资)

The salary could be calculated on piecework system and timerate system.

雇主将根据实际工作情况及工作条件将工资制度分为计件工资与计时工资两种

6.1 Piecework System 计件工资制

The Employee’s salary shall be calculated strictly on piecework system. Piecework

system shall adopt the following quota rate (S$) which may be revised or adjusted

by the Employer at their absolute discretion from time to time. Any revision or

adjustment of the piecework rates per unit stated below will be notified to the

Employee from the supervisors:

(a) Timber formwork 4.00-8.00/m2

(b) Metal formwork 4.00-8.00/ m2

(c) Rebar 50.00-120.00/ton

(d) Bricklaying 2.00—3.50/m2

(e) Plastering 1.50—3.00/m2

(f) Tiling 5.00—8.00/m2

(g) Concrete 3.00—9.00/m2

雇员在新加坡的工资收入严格按计件工资制计算。计件工资按以下定额单

价(新元为单位)执行:

木 模 4.00-8.00/ 平 方 米

铁 模 4.00-8.00/ 平 方 米

钢 筋 50.00-120.00/ 吨

砌 砖 2.00—3.50/ 平 方 米

抹 灰 1.50—3.00/ 平 方 米

雇主将根据实际情况对以上定额单价进行调整和修改并相应通知雇员。

6.1.1Based on the above system, the Employees under full attendance would be

classify into 4 classes that the Employee can perform his duties competently,

efficiently, safely and can deliver the qualified products according to the Employer’s

requirements and assignments.

在以上定额计价体制下,雇员在确保施工质量并按时完成所分配的工作量

的情况下,全勤雇员的平均每天工资将分为四个等级,雇员将按技能、工

作质量、工作效率、出勤率及安全操作五项指标将工人分为四级。其中,

A级,每人新币55.00-60.00元/天

B级,每人新币50.00-55.00元/天

C级,每人新币45.00-50.00元/天

D级,每人新币40.00-45.00元/天

Class A, $55.00-60.00/day

Class B, $50.00-55.00/day

Class C, $45.00-50.00/day

Class D, $40.00-45.00/day

The data above is for reference only, the actual figure should be

based on piecework system.

以上工资标准为参考数据,具体数额将由计件工资制确定。

6.1.2 Upon the arrival in Singapore, the Employer would classify the Employees. If the

Employee could not satisfy the requirements of Class D, the Employer has the

right to dismiss the Employee according to the Employment Contract. And the

Employer would afford the air-ticket.

雇员抵新3个月后,由雇主分级,达不到D级的雇员将按雇佣合同将其辞退。雇主

承担回程机票。

6.1.3 Upon the completion of the 1st year’s employment , the Employee should satisfy

the requirements of Class C. Or the Employer has the right to refuse the renewal

request by the Employee. The Employer would only afford the air-ticket (The

domestic agent fee and any other fees could not bear by the Employer).

雇员一年期满后,必须达到C级,否则雇主有权不予延期。雇主除负责回程机票,

不负责其他任何费用(包括国内代理费)。

6.1.4 Upon the completion of 2nd year’s employment, the Employee who could satisfy

the requirements of Class B could renew his Employment Contract.

雇员两年合约期满后,必须达到B级才可被延期聘用。

6.1.5 The Employer has the right to upgrade and downgrade the Class due to the

performance of the Employee.

雇主将根据雇员表现和综合评分决定其升降级事宜。

6.2 Timerate System计时工资制

Besides the above system, if it is not applicable, the Employees’ salary also

could be calculated based on timerate.

在以上定额计价之外,如果工作情况不适用计件工资,雇员工资在需要时,

还可以以计时工资制计算。

6.2.1 Standard Rate 标准计时工资

Under this system, during normal hours (within 8 hours, 8:00-12:00, 13:00-17:00 on

weekdays, and 8:00-12:00 on Saturdays) the standard rate is S$3.00/ hour.

按此计算方法,8小时以内(平时工作日的早8点到中午12点,下午1点

到5点,周六上午的8:00-12:00)计时工资标准是新币3.00元/每小

时。

6.2.2 Rate for Overtime 加班工资率

As per request by the Employee and the construction schedule,

the Employer may arrange the Employee to work beyond normal

working hours (this may include night shift, working after 13:00 on

Saturday afternoon, Sundays and Public Holidays), both of the

Employer and the Employee agree the rate could be calculated as

Standard Rate S$3.00+ OT Rate S$1.50=S$4.50 per hour. And the

Employee also agrees that he must perform his duties competently, efficiently,

safely, and can deliver the qualified products on time and satisfy the minimum

requirement of the Employer’s.

根据雇员自愿要求,雇主可安排雇员在正常工作时间外工作(包括:夜

班、周六下午1点后、周日及公共假日),雇主与雇员双方一致同意,这期

间的工资按:基本工资新币3.00元+加班工资新币1.50元,即新币4.50

元/每小时的加班工资率来计算。但获得加班工资的前提是,雇员必须确保

施工质量、安全操作的要求,雇员还要遵守准时完工和最低标准等方面雇

主的要求。

6.2.3 Allowance Rate for Normal Hours正常工作时间内的福利工资率

Considering various facts as the followings-:

the Employee’s requests, the uncontrollable reasons that could

cause the loss of working time, the Employment Act and other

rules & regulations in Singapore for the Employee’s Welfare, and

the subsidy for the Employee’s Annual Leave, Both of the

Employee and the Employer agree that during the normal

hours, the rate could be calculated as standard rate S$3.00+

allowance rate S$1.00=S$4.00 per hour. This extra Allowance Rate, S$1.00 per

hour has included all the allowance related to the Employment Act and other Rules

& Regulations in Singapore. But the standard rate calculated on timerate is still

S$3.00 per hour.

根据雇员要求以及雇主考虑雇员雇佣期间的未休年假的工作补贴、雇佣期内非人为

因素造成的误工补贴,以及各种相关规定所规定的福利补贴,雇主与雇员双方同

意,雇主给予雇员正常工作时间内每小时新币1.00元的福利工资, 8小时内的工资

计算按标准工资新币3.00元+福利工资新币1.00元,即新币4.00元/每小

时计算。额外的新币1.00元的福利工资率已经包括了上述有关的一切福

利。但该福利并不影响双方一致同意的8小时以内的标准计时工资。

The calculation for max allowance per month is listed as the

followings (considering 4 weeks per month);

-:

From Monday to Friday, S$1.00 X 8hrX 5 dys X4 weeks=S$160.00 Saturday, S$1.00X4hrX4weeks=S$16.00 ;

So every month the Employer will grant the welfare S$176.00

(S$160.00+S$16.00=S$176.00) to the Employee.

This calculation is for reference only. The totally actual allowance

should be calculated by the attendance rate of the Employee’s.

雇主补贴给雇员的福利,每月最多的数额可计算如下(每月按4周计):

周一至周五,每小时补新币1.00元,每天补8小时,每月合计新币

160.00元,即1.00X8X5X4=160.00元。

周六,每小时补新币1.00元,每天补4小时,合计新币16.00元,即

1.00X4X4=16.00元

则,每月雇主补偿雇员的福利为新币176.00元,即

160.00+16.00=176.00元。

此计算方式及总数额仅为参考,实际补贴数额,将按雇员实际出勤天数计

算。

6.2.4 Any manday loss that the Employer promises to pay for the

Employee, or the MC wages during the Employee’s injury, the

standard rate should be calculated as S$24.00 per day (base on 8

working hours and standard rate S$3.00 per hour).

若因雇主承诺的误工补偿或雇员工伤发生工伤期间的工伤工资,每天的工资标

准为新币24.00元 (按标准计时工资每小时新币3.00元和每天8小时的工作时

间计算)。

7.

7.1 Health, Safety & Good Faith (健康、安全与忠诚) It shall be the duty of the Employee to take reasonable care for his own health and

safety and that of other persons who may be affected by his acts or omissions at

work and to co-operate with the Employer so far as is necessary to perform any

duty or to comply with any requirement on workplace health and safety imposed

by the Singapore law from time to time.

雇员有责任在工作时采取一切合理的方法照管好自己和可能受到自己行为影

响的周围其他人员的健康与安全,并配合雇主一切必要的健康与安全的措施

和/或遵守新加坡法律针对工作场所而经常制定的健康安全要求。

7.2 The Employee must comply fully with all health, safety or work regulations from

time to time introduced by the Employer and notified to the Employee.

雇员必须完全遵守雇主制定的关于健康、安全或工作要求等方面的规定。

7.3 The Employee shall devote the whole of his time, attention and skill in his working

hours to the complete his assigned work or task in a competent and efficient

manner.

雇员在工作期间必须全力付出,毫无保留地用自己的工作技能来有效地完

成雇主所分配的工作内容或任务。

7.4 The Employee shall not directly or indirectly carry on or assist in carrying on or be

employed, involved or engaged in any other work or business for any other person

in Singapore other than the Employer irrespective of whether the Employee is

paid or received a remuneration for such other work or business.

雇员不能直接或间接地为除雇主以外的其他任何人从事或涉及任何性质的工

作或业务,不管是否从中获得收益。

8. Sickness or Injury (病假医疗)

8.1 Every Employee shall notify or arrange someone to notify the Employer on the

first day of each absence from work or as soon after as it is practicable and shall

state the reason for and expected duration of the absence.

任何雇员如果不能上班,必须在没有上班的第一天或尽可能最早的时间亲自

或委托他人通知雇主,并说明不能上班的原因及不能上班的预计天数。

8.2 Where the absence is due to illness or injury, the Employee shall be required to

produce, without demand by the Employer, the original medical leave certificate

from an approved hospital, polyclinic or medical clinic at the end of seven (7) days

(or such other period as is appropriate) from the start of the absence.

如果雇员因生病或受伤不能上班,必须在从没有上班的第一天起,7天之内

(或其他客观合理的期限)主动向雇主出示经新加坡批准的医院或诊所等

所出具的病假证明,而不需要雇主要求后才出示。

8.3 The Employer shall neither be responsible nor liable to pay for any medical

charges, fees or expenses of the Employee in respect treatment for any non work-

related illness, injury or disability or if the injury, illness or disability arise outside

the course of employment with the Employer,except for S$20.00 compensation

per month during the employment.

雇员在雇佣期间因非工作性质的疾病或受伤而发生的任何医药费或诊断费或

治疗费等,雇员都应负责支付,雇主在其雇佣期内可以每月给予20新元的

医药费报销。雇员不是在本雇佣期内发生的疾病或受伤,所涉及的任何医

药费或诊断费或治疗费等,雇主也不予负责承担。

8.4 The Employer will render such reasonable assistance to the Employee to make a

claim under the medical insurance coverage provided that the Employer shall not

be liable to pay or to compensate the Employee if his claim exceeds the limit of

the insurance coverage or if the claim is rejected by the insurer for any reason

whatsoever.

雇主也将为雇员提供合理的协助,以帮助他们在规定的保险范围内向保险

公司进行医疗索赔。但是,如果该医疗索赔超过强制保险规定的范围或保

险公司无论以任何理由拒绝该索赔,雇主不为此承担任何支付或赔偿的责

任。

9. Group Personal Accident Insurance (事故保险)

9.1 It shall be mandatory for every Employee to participate in a group personal

accident insurance program provided by an insurance company designated by the

Employer for any death, injury or incapacity suffered by the Employee, whether

work-related or otherwise, for so long as he remains an Employee of the Employer

in Singapore.

为保障雇员在雇佣期内,无论是否与工作有关而发生意外事故致死或受伤或

致残后能够有所赔偿,雇员须参与雇主在新加坡指定保险公司为雇员投保

的一份“人身安全保险计划”。

9.2 The Employee hereby authorize the Employer to retain S$100-150 (or such

insurance premium from time to time as determined by the Employer) from the

Employee’s salary every year to pay for the insurance premium on behalf of the

Employee to the designated insurance company.

雇员由此授权雇主每年从工资里保留100-150新元作为保费并由雇主代为

支付给指定的保险公司。

10. Industrial Accident (工 伤 处 理) 10.1 If there was an industrial accident happened in the Employer’s construction site

and it is reportable to Ministry of Manpower, the Employee should inform the

representatives of the Employer and the Safety Officer (Workplace Safety &

Health Officer-WSH Officer) of the Main contractor during 24 hours of the accident

happened. Then the Employer could assist the Employee to make a claim under

workmen compensation policy to cover his injury and disability.

如果雇员确实在雇主的工地发生工伤并需通报人力部,应在24小时内通知

雇主的代表和主包的安全官,雇主根据相关程序协助雇员进行工伤索赔,

以保护雇员因工作而导致的受伤或伤残等。

10.2 The Employee agrees and undertakes to: (雇员同意并承诺:)

(a) give written notice of any injury or illness suffered by the Employee in

any industrial accident during the course of his employment on the day of

the industrial accident itself or as soon after as it is practicable (not more

than three days) to the Employer;

在工伤或工作疾病发生的当天或尽可能最早的时间内(不超过三

天),书面通知雇主;

(b) fully co-operate with any investigation into the industrial accident carried

out or conducted by the Employer;

全力配合雇主为此工伤所进行的调查;

(c) give full and frank disclosure to the Employer of all information and

circumstances concerning the industrial accident and to identify and

disclose the name of all eye witnesses, if any; and submit all the MC and

Medical documents

全面而真实地告诉雇主所有与该工伤有关的信息和当时的工作环境

(如果有目击证人,必须全部列出);提交全部的病假条和其他医药证

10.3 The Employee must strictly comply with all the Employer’s rules and regulations in

respect of industrial accident stated in Annex A failing which the Employer may at

their absolute discretion take appropriate disciplinary action.

雇员发生工伤后,必须严格遵守雇主为工伤管理制定的相关规章制度 (详

见附件A)。如果违犯,雇主将采取一切合适的纪律处罚措施。

11. Employee’s Savings Scheme (雇员托存款)

11.1 The Employee hereby irrevocably and unconditionally authorizes the Employer to

retain a sum of money from his salary every month as compulsory saving for the

Employee in the following manner:

雇员特此授权雇主按照以下方式每月从其工资中留存部分数额作为

必需的托存款。本授权不可撤回和无条件执行。

11.2 The Employee hereby irrevocably authorizes and empowers the Employer to deal

with the compulsory saving of the Employee in the following order of priority:

雇员特此授权雇主按照以下优先顺序处理以上必需的托存款。本授权

不可撤回和无条件执行。

(a) to pay income tax, if any, imposed on the Employee by the Singapore tax

authority;

支付新加坡政府要求的个人所得税(如果有);

(b) to pay any indebtedness howsoever arising due from the Employee to the

Employer which may include but not limited to accommodation and/or

utilities services provided, medical fees/charges paid by the Employer on

behalf of the Employee (if any), advances or loans or adjustment of over-

payment of salary (if any), repatriation costs or any loss and damage

suffered by the Employer arising from any breach of the employment

contract by the Employee

支付雇主以下费用 (但不限于):

水电住宿费;雇主代雇员垫付的本应由雇员自己承担的医疗费(如

果有);雇员借款或雇主预发或多发的工资(如果有);雇员违犯

雇佣合同相关条款而给雇主造成的损失(如果有)等。

12.

Repatriation (送返) Upon the successful completion of this two (2) years’ employment contract by the

Employee without committing any breach of the employment contract, the

Employer undertakes to bear the air-ticket costs of the Employee to his domestic

country provided. And the arrival place should be decided by the employer. The

transport fee from airport in his domestic country to the original residential place

shall be born by the employee himself.

雇员完整履行两年的雇佣合同后,雇主将负责安排机票,将雇员送回国。

但降落机场由雇主根据当时的实际情况决定,从国内机场至国内居住地的

交通费由雇员承担。

13. Termination Generally (终止合同)

13.1 If the Employee terminates the employment contract at any time before the expiry

of this two-year contract due to his own volition, or his neglect, default or

misconduct or if the Employee is deported by the Singapore authority due to his

own default or neglect or if the work permit of the Employee is cancelled or cannot

be renewed due to the default or neglect of the Employee, the Employee shall be

liable for the loss of the employer’s. The details please refer to Annex A.

如果雇员在两年合同期满之前任何时候主动终止合同,或由于雇员不能胜任工作或

违规犯错或不正当行为而导致被雇主解雇或被新加坡政府驱逐出境或准证不能延长

等,在此情况下,雇员必须赔偿雇主。具体细节参照附件A.

13.2 Return of the Employer’s belongings(归还雇主财物)

Once this Contract was terminated, the Employee must return all the belongings

14. Termination for medical reasons (因健康原因终止合同)

14.1 If the health of the Employee, as certified by the medical practitioner, is so

impaired and/or is unfit to carry on with his assigned trade/task under the

employment contract without any default or neglect on the part of the Employee,

the Employer reserves the right to terminate this employment agreement without

being liable for any compensation to the Employee.

15. Disciplinary Rules (纪 律 处 分)

15.1 The Employee must at all times strictly observe all the terms and conditions of the

employment contract, including but not limited to all the rules and regulations of

the Employer set out in Annex A which may be amended, revised or modified by

the Employer from time to time and any such amendments, revisions or

modifications shall continue to bind the Employee accordingly upon notification to

the Employee from his supervisor and/or posted on the notice board at the

general office of the work site.

雇员必须严格遵守本合同条款,包括附件A中雇主制定的各项规章制度等。雇主将

根据实际情况对附件A中的内容进行修改、完善和增补等并将相关内容通知雇员,

而这些修改和增补的内容及通知和或/张贴在工地上的通知内容等也同样对雇员具有

15.2 In cases of serious misconduct or incompetence, the Employee may be dismissed

without any period of prior notice or warning. In other cases, the Employee will be

given an oral warning in the case of first offence and a written warning in the case

of a subsequent offence before being dismissed.

如果雇员有严重不当行为或严重不能胜任工作,雇主将即刻解雇雇员而不需要提前

警告或通知。但在一般违规情况下,雇主将第一次口头警告和第二次书面警告,在

此之后雇员如果继续再犯,将被解雇。

15.3 The Employee may be suspended from employment without pay as an alternative

to dismissal or during the investigation of any alleged misconduct or

incompetence.

作为雇主终止合同的替代办法,雇主可对雇员处以停工,或在调查雇员不当行为或

不能胜任工作的具体情况期间要求雇员停工。在停工期间雇员没有工资。

15.4 The Employer may take some disciplinary action other than dismissal such as

suspension without pay, demotion, withdrawal or suspension of subsidized

accommodation, food and utilities services, transfer to some other place or type of

work or loss of allowances, privileges, etc.

雇主对违规雇员除采取解雇的处罚方式以外,还可以对其处以纪律处分,譬如无薪

停工,降级,取消住宿、水电及设施津贴,调换工地或工作性质,取消各项津贴或

待遇等。

15.5 Without prejudice to the generality of the above and without setting out a

comprehensive definition of the expression, serious misconduct by the Employee

may include:

- theft or reasonable suspicion of theft or other criminal offence

- breaches of workplace safety and health rules and regulations

15.6 An oral warning may be given by the immediate supervisor of the Employee.

Written warnings will be given by either the site manager or project manager.

Dismissal or other major disciplinary action will be made by the Office of the

Employer.

雇或其他严重违纪违规行为,其处罚由雇主的办公室发出。

16. Precedent & Severance (优先和异议)

16.1 In the event of any inconsistencies or conflict between the English and Chinese

translated versions of any terms and conditions of the employment agreement, the

English version shall take precedence.

本合同条款均有中英文对照翻译,如有不符,以英文为先

16.2 If any provision of this employment agreement is declared by any judicial or other

competent authority to be void, voidable, illegal or otherwise unenforceable, the

parties shall amend that provision in such reasonable manner as achieves the

intention of the parties without illegality or at the discretion of Employer it may be

severed from this employment agreement and/or the remaining provisions of this

employment agreement shall remain in full force and effect.

如果本合同任何条款被司法部门或其他相关权力部门宣布无效,撤销,非法或不可

执行等,合同各方应本着合理的态度和方式修正该条款。而本合同的其他条款仍可

执行和有效。

17.

Entire agreement (合同的完整性) This employment agreement is the complete and exclusive statement of the

agreement between the Employer and the Employee relating to the subject matter

of the employment agreement and supersedes all previous communications,

representations and arrangements, written or oral. The Employee acknowledges

that no reliance is placed on any representation made but not embodied in this

employment agreement.

18. Governing Law (适用法律)

This employment contract shall be governed by and construed according to the

laws of the Republic of Singapore.

Dispute Resolution (争端解决) Any dispute arising out of or in connection with this employment contract,

including any question regarding its existence, validity or termination, shall be

referred to and finally resolved by arbitration in Singapore by a single arbitrator in

accordance with the Arbitration Act (Chapter 10) for the time being in force.

有关本合同的任何争端,包括合同的真实,有效或终止等,按照现行仲裁法(10

《雇佣外籍建筑工人合同》 附 件A

第1条 雇员的工作职责

1-1 能够按照图样施工,保证工作质量符合要求。

1-2 负责每项工作结束后的现场清理,保证下道工序工作。

1-3 严格按照雇主对现场施工人员的操作要求进行施工,不能凭自己意愿随

意施工。对操作不当所造成的返工修补、损失,由雇员负责。

1-4 不超用、浪费、损坏材料,无故丢失或非正常操作造成损失的由雇员赔

偿。

1-5 文明施工,严格按安全规章操作。

1-6 雇员必须随时服从工作需要和安排,包括与自身专业不同的工作(如木

工可以做混凝土工及其他工种的工作等),雇员不得因从事专业以外的

工作而提出工资待遇过高的要求或拒绝接受此项工作。

1-7 鉴于新加坡的实际情况,雇主已将工资标准及发放的办法在合同中作了

规定,雇员已表示同意。雇员到新后不得因与其他国家工人或其他中国

工人攀比收入而闹事。雇主有权对表现好的工人进行奖励,其他人不得

攀比。

1-8 雇员必须服从雇主或指定代表的领导与管理,雇员无权要求选择工作地

点或班组。

1-9 雇主分配给雇员使用的施工材料,雇员要按雇主要求迅速将材料运至工

作面,否则,雇主有权停止雇员工作。

1-10 雇员要自觉参加雇主的各项活动,不迟到,不早退,不能缺席。

1-11 凡违反以上条款,雇员将无条件接受雇主的处罚,处罚包括:赔偿(按

实际)、扣薪、罚款、停工等。因处罚而闹事者,加倍处罚,直至解雇

遣回。

1-12 雇员应严格按照雇主所制定的质量、安全与环境管理的操作要求进行施

工。若工人凭自己的意愿随意施工,或因操作不当所造成的后果,雇主

或甲方(雇主提供相关证据)将依据当时的施工记录予以相应的经济和法

律责任追究。

第2条 工资

2-1 雇员以计件工资制所做的工作,因质量不合格而返工的不予雇员结算工

资。前三月工资不低于1500新元,以后按能力平均工资约1600-1800新元。

2-2 雇主有权根据市场情况和公司经营情况自主调低或调高计件工资制的定

额单价。调整定额单价对以前执行的标准将不进行追补或减扣。

2-3 雇员不论在哪个工地工作,计件工资的计算均按工地当时的标准执行。

2-4 雇员工资由雇主核算并根据合同留存各种款项后(包括雇员的托存

款),于雇员履行合约后的下个月月末发放基本工资给雇员。全部款项

结清以工资各月结算为准。

第3条 雇员抵新及生活福利待遇

3-1 雇主在雇员到达新加坡后负责到机场接机,帮助雇员办理入境手续,并 预支每人200新元作为当月的生活费,此数从雇员该月工资中扣除。

3-2 雇主在雇员抵新一周内,组织雇员到新加坡指定的医院体检。由于雇员 自身原因,体检不合格者将被辞退,一切经济损失及法律责任由雇员自 行承担。

3-3 雇主将按照新加坡政府主管当局的要求为雇员提供有关技术培训,雇员 在获得技术证书后,必须为雇主服务两年,否则在回国结算时,按实际

发生费用赔偿雇主损失;若雇员不能通过有关考试并获得技术证书,所 有考试及培训费用由雇员承担。 纪 律 雇员如果不遵守以下规定或要求,将即刻被解雇而不需要提前警告或通知: ? 雇员只能为雇主工作,不得以任何形式变更雇主或私逃。 ? 雇员不得参与其他非法商业与个人活动或成为任何公司的合作伙伴及董事。 ? 雇员不得从事任何违法、不道德或不良活动。 ? 雇员不得结伙滋生事端,打架伤人。 ? 雇员不得让非本公司雇员或非法劳工在住地留宿。 ? 雇员不得与新加坡人或永久居民同居。 ? 雇员不得连续旷工三天以上。 ? 雇员在取消工作准证后不得拒不离境,逾期逗留。 ? 雇员不得以任何形式参与罢工。 ? 雇员不得煽动闹事。 ? 雇员不得发表不利于雇主的言论,不得蔑视雇主、不得随意到新加坡政府有关部门诬告投诉。 ? 雇员不得拒不上工或在合同期满之前要求回国。 ? 雇员拒不服从雇主调动。 ? 一旦查证工伤是由雇员故意造成的自残。 ? 雇员必须在雇主按新加坡规定的合法日期离新回国。雇员回国前有足够时间解决工资遗留问题;对此,雇员在任何情况下不得以解决遗留问题为借口,滞留机场,拒不离境。 ? 凡被遣送人员。 任何人偷窃,非法打黑工或贩卖走私烟等, 雇主将移送新加坡警方处理。 工伤处理 雇员发生工伤以后,必须严格遵照新加坡雇主关于工伤调查、申报、索赔及所有处理程序。雇员在没有通知雇主的情况下,即没有履行书面通知雇主的情况下,不得擅自到新加坡政府部门或其他相关办事机构去投诉。 雇员发生工伤以后,如查证属实,雇主将按照新加坡相关法律法规进行申报并理赔。 17 姓名:___________________ 日期: ________

5-9 严厉禁止任何工伤工人不通过雇主擅自到保险公司催办或查询任何事情而影响保险公司的正常工作。 自残是欺骗行为。根据新加坡相关法律法规,欺骗是违法的。因此,如果已经上报新加坡政府的工伤事件最终证明是雇员自残或与工作无关而造成的,雇员的托存款将以作为雇员由此给雇主造成损失的赔偿。 雇员发生工伤并上报新加坡政府人力部以后,必须服从新加坡雇主为工伤管理所制定的各项规章制度. 对于上报政府的工伤雇员,雇主将先垫付每月200新元作为其生活费。同时,工伤雇员在工伤等待赔偿期间应谨慎使用雇主预支的生活费。 属于工伤保险范围内的伤残,如雇员本人自愿提出申请放弃索赔,则雇主收到雇员“自愿放弃工伤索赔声明书”后,按医生开具的有关证明报销相关医药费及每天24.00新币的工伤工资。 药 费 单 报 销: 上报政府人力部的工伤雇员的一切医药单、病假单原件及所有医院记录都应如数按时送交雇主以办理索赔事宜。否则,一切因此造成的拖延后果由雇员自负。 拒绝人力部处理工伤赔偿或聘请律师起诉公司的雇员,将被视作自动放弃托存

款及公司的各项生活费补助、医药费报销和工伤工资。相关行政费、律师费及

回国机票由雇员自行承担。

第6条 自愿声明书

6-1 我是自愿在新加坡工作,自愿签署雇佣合同书。

6-2 我清楚的知道,我的雇主_________________公司已授权 _______________

公司对我进行全权管理,并负责处理与雇佣合同有关的所有事宜,我保证服从

该公司的管理,执行该公司的管理体制。

6-3 我清楚的知道,如果我行为违反了合同规定,雇佣公司作为雇主的授权公司有

权终止合同,遣送我回国。

6-4 在执行定额计件工资制期间,我不再要求任何加班工资,包括星期天和节假日

的工作。

6-5 如果我对当月工资有异议,必须从发工资之日起7天内向公司申诉,超过7天

可视为放弃申诉,我保证决不以“不领工资”为借口要挟雇主或雇佣公司。

6-6 我在此声明,我在中国国内发生的任何经济纠纷与新加坡雇主无关,我决不会

把这类事情带到工作上来,要求雇主和雇佣公司协助解决。如果是我与国内中

介单位签署的代理服务合同发生纠纷,经协商不能解决的本人自愿遣送回国,

由争议双方在中国境内依据中国法律解决,与雇主和雇佣公司无关。

6-7 因我个人原因(如:技术达不到要求、身体不适应、无医生证明之病由,自已

要求回国、家庭事由等),不满合同期,要求提前回国,或有停工、旷工记录

或因犯法、犯错等原因,被新加坡政府或雇主勒令出境者,我自愿向雇主赔

偿,其赔偿范围及方法为:

(1)我自愿付清给雇主的遣送费S$1000.00新元,并按提前回国时间赔偿雇主每

月S$600.00新元。如有第二年合约按照同样办法执行。

(2)如因自身原因(如技术达不到要求,无医生证明之病由,家庭事由等),

致使我无法完成本合同而提前解约,托存款不予退还。

(3)我自愿承担回国机票及机场税(计算时,雇主将从雇员工资中扣除)。

第7条 其他

7-1 雇主为雇员在两年基本雇佣期内,一次性免费提供一双安全鞋,一顶安

全帽和一条安全带的劳动保护物品,损坏添补由雇员自理。

7-2 雇主一次性提供必要生产工具,雇员要小心妥善保管工具。丢失损坏工

具,由雇员出资雇主购买补齐,损坏工具自费修理

7-3 如雇员在雇佣期间在新加坡工伤死亡,雇主负责指定专人将其遗体火

化,并将骨灰送回中国,费用由雇主负担。雇主将按新加坡法令负责处

理死亡索赔的全部事宜,并将索赔金全数交付雇员家属。无论何种死

亡,雇员家属均应全权委托雇主在新加坡处理后事。若雇员家属坚持来

新参与后事处理,所涉及一切费用应由雇员家属自行承担。

7-4 雇员在新加坡触犯法律,则由本人承担全部责任。雇员不得因此提出由

雇主为其担保等无理要求。

7-5 雇员入新加坡后,医院体检患肝炎、肺病、心脏病、高血压、 痢疾等

任何疾病而不能通过新加坡的体检时,雇员应自己承担往返机票费用,

立即回国。若拒不回国,超过新加坡政府限定的日期,一切后果由雇员

自负。

本附件是“雇佣外籍建筑工人合同”的一部分。
