WARRANTY GUARANTEE
To :JAI DURGA PAPER MILLS (P) LTD.
Near Bhore Sahib Gurdwara Vill. Gaunspura Humbran Road, Ludhiana
We have been informed that NANNING WEMET INTERNATIONAL COMPLETE PLANT ENGINEERING CO., LTD. (Registered office:Unit A-F, 30th Floor, International Chamber of Commerce Tower,No.59 Jinhu Road, Qingxiu District, Nanning City, Guangxi, P.R. China) (hereinafter called ' the Principal '), has entered into PURCHASE ORDER No.-JDPL/LDH/MM/68/11-12 with L/C No.0506511IM0000105 issued at 05.12.2011 for the supply of DISK
THICKENER details as per PROFOMA INVOICE No.WM/QT/EX1/JD/2011-015 dated 06.05.2011 at the total value of USD53500.00.
Furthermore, we understand that, according to the conditions of the L/C, a warranty guarantee for USD5350.00 is required.
At the request of the Principal, we Bank of China Ltd., Guangxi Branch hereby irrevocably undertake to pay you any sum or sums not exceeding in total an amount of USD5350.00 (say U.S.Dollars Five thousand Three hundred and Fifty Only) upon receipt by us of your first written demand stating that the Principal is in breach of his obligation(s)under the underlying contract and the respect in which the Principal is in breach.
Your demands for payment must also be accompanied by the following document(s):
1.Be accompanied by your signed statement certifying the nature of the defect discovered and the extent of the damage caused thereby and confirming that the Principal has not fulfilled his warranty obligations towards the equipments (not including wear and tear parts) under item No.
This Guarantee remains valid for a period of EIGHTEEN MONTHS from the issuance date of Bill of Lading unless you release u from all liabilities under this guarantee earlier.
This guarantee does not apply to wear and tear parts of the equipments.
Consequently, any demand for payment under it must be received by us at this office on or before EIGHTEEN MONTHS from the issuance date of Bill of Lading. Upon expiry, this Guarantee shall automatically become null and void whether or not it is returned to us for cancellation.
This Guarantee is subject to the Uniform Rules for Demand Guarantees, ICC Publication NO.758.
