三、部分聘用条款
1、 合同期:试用期 3 个月,合同期 3 年;
2、 薪 资:试用期工资 (税前),转正工资 (税前);(按公司制度,请遵守薪资保密制度,请勿向任何第三方泄露。)
3、 公司实行单双周工作,以上薪资包括单周周六加班费用;
4、 年终奖:具体数额视公司业绩和个人绩效、在职时间等而定;
5、 其他福利:社会劳动保障5项保险和住房公积金等福利政策按公司既有政策执行。

Offer Letter
Dear Mr. XXX
We are pleased to offer you the position of Automation Engineer currently reporting to Maintenance Manager with the terms and conditions stated as below. The position currently based on XXX, China
Commencement Date:
Your employment with XXX limited (hereafter referred to as “Company”) commences on the 1st of Jan, 2012 or as otherwise agreed by you and the Company. And you are supposed to sign a three years employment contract with XXX Plant.
Probation Period:
You will be employed on probation for a period of Six months from Commencement Date.
Compensation:
Your Monthly Gross Salary will be includes all legal or mandatory allowances and subsidies.
Tax:
In accordance with PRC laws and related regulations, the Company will withhold and submit your individual income tax from your salary on a monthly basis.
Statutory Social Security Benefits:
You are entitled to join statutory social security benefits and statutory housing fund programs as per PRC laws and related Longkou local regulations. The Company shall pay its contribution of the benefits, and withhold and submit your contribution from your salary on a monthly basis.
Leave Policy:
You will be entitled to working days annual paid vacation in addition to the public holidays in China for each calendar year.
Confidentiality/Non-Compete
Upon your employment, you will be expected to sign a document agreeing not to join a competitor, or solicit customers or employees if you decide to leave the company. In addition, you will agree not to disclose confidential or proprietary information during or after your employment with the Company to anyone for any reason. Non-compete and non-solicitation is in force for 2 year after termination.
Employment Conditions:
Notwithstanding the offer letter, your employment with the Company shall not be effective 1/2

until the following requirements are met:
1. Your background investigation must be satisfactory by the Company;
2. You report for duty and commence work for the Company on the Commencement Date hereof;
3. Before commencing work at the Company, you shall first take a medical check-up at a Company-appointed hospital, and provide to the Company a qualification issued by this hospital indicating your physical fitness for the job.
4. If you are not a fresh graduate, you shall provide a termination certificate from your previous employer upon commencement of work with the Company;
5. Your personal files mush be kept in the Company (or a third party appointed by the Company);
6. Your statutory social security account shall be transferred to the Company within a month after you commence work for the Company;
7. You are not under any non-compete agreement with any of the Company’s competitors;
8. A labor contract must be signed by you and the Company upon commencement of work.
9. All the information you provided to the company must be genuine (e.g. resume, education certificate, employment letter )
You must have terminated employment with your previous employer before entering this employment with the Company, and are not under any form of employment with any other organizations. Your being employed by the Company shall not constitute a breach of any obligations you have established with your previous employer, nor shall it subject the Company to any legal liabilities to any third party.
You confirm that this Offer Letter is an attachment of the Labor Contract. In case of any conflict or discrepancy between the terms of this Offer Letter and those of the Labor Contract, the Labor Contract shall prevail.
Please acknowledge your acceptance of the terms and conditions by signing both copies of this Offer Letter, and kindly return one signed copy to the Company’s Human Resources Department no later than the 15th July, 2011.
