摘 要
物权变动是物权立法的核心问题之一,而善意第三人的利益保护问题则是物权变动的重要内容。本文通过对公示公信原则、善意取得制度和物权行为无因性理论的论述、分析和比较,认为公示公信原则作为现代物权法的基本原则之一,是物权变动中善意第三人利益保护的理论基础;善意取得制度是公示公信原则的具体体现,而且在我国《物权法》中得到了一系列完善,可以承担起保护善意第三人利益的使命;物权行为无因性理论虽在一定程度上可以保障交易安全,在物权变动中规定对第三人利益的保护,其意义非常重大,很多学者为此提出了各种保护第三人利益的规则,但是由于其争议不断,且自身存在很多弊端和缺陷,应当予以摈弃。进而,笔者认为应以公示公信原则为基础,结合善意取得制度来保护物权变动中善意第三人的利益。

Abstract
The change of real right is one of the core issues, and the protection of third party’s interests acting in good faith is an important content of the change of real right. Based on the letter the principle of publicity, goodwill and a system of property rights without due to the exposition of the theory, analysis and comparison, demonstrative principle of real right is one of the basic principles of modern property law ,the theoretical foundation of the protection of third party’s interests acting in good faith in the change of real right. Acquisition in good faith is a concrete manifestation of the demonstrative principle of real right, and also be developed in China's 《Property Rights Law》,can take up to protect third party’s interests acting in good faith . Although the real right behavior without reason can protect the safety of transactions, because of it has many constant disputes, and its own drawbacks and defects ,should be rejected. Furthermore, I think that our law should be based on the demonstrative principle of real right, together with acquisition in good faith to protect third party acting in good faith in the change of real right.
